| Judicial Review - Naturalization Decisions |

| Initial jurisdiction to rule on applications for naturalization is given to the U.S. Customs and Immigration Service (USCIS, formerly the Immigration and Naturalization Service) exclusively pursuant to § 310 of the Immigration and Naturalization Act (INA). If a naturalization application is denied, a person can appeal for a "de novo" (or completely new) review of the application by a court. This review by a court is called "judicial review."

| Section 231 of the Immigration and Naturalization Act (INA) sets forth the requirements for commercial ships and aircraft to keep records of its passengers. The term "ship" in this article is intended to cover any type or size of sea-worthy vessel. A designated person on each transportation craft must maintain lists with information on each passenger, crew member, or other category of occupant who is transported on a ship or aircraft. The designated list-keeper may be the craft's master or commanding officer, authorized agent, or owner, for example. The information must be given to a United States border official both when the ship or aircraft is arriving at a U.S. port of entry and when it is departing from a U.S. port. | Visa Types - Lawful Permanent Resident Spouse And Child - V-1, V-2, V-3 |
|
| In addition to eligibility for a permanent visa under the family second preference, the alien spouse and children of a permanent U.S. resident are eligible for nonimmigrant visas, designated V-1, V-2, and V-3 visas. The V series is designed to allow qualifying aliens to wait in the U.S. for their permanent immigrant visas to be issued. Aliens applying for V visas must have petitions for immigrant visas pending.

| There are at least four types of actions for damages that may be brought by aliens as a result of their alleged treatment by governmental officials: (1) claims under the Federal Tort Claims Act; (2) actions under the federal civil rights statutes; (3) Bivens actions; and (4) private causes of action.
